Overview

These Terms govern your use of ChatSnag, an Instagram comment-to-DM automation tool built on Meta's official Instagram API for Instagram professional accounts. By creating an account or using the service, you agree to these Terms. The contracting party is ChatSnag, and you can reach us at hi@chatsnag.com.

1. Platform disclaimer and no guarantee

Instagram is operated by Meta, not by us. We cannot guarantee your account standing, message delivery, or the continued availability of the Instagram API. Using any third-party tool with Instagram is at your own risk with respect to Meta's enforcement. ChatSnag promises you visibility into what happened through your activity log. It does not promise that any given DM will be delivered. We disclaim liability for Instagram account restrictions, suspensions, or bans.

2. Limitation of liability and indemnification

To the maximum extent permitted by law, ChatSnag's total liability for any claim arising out of or relating to the service is limited to the fees you paid us in the twelve months before the event giving rise to the claim. We are not liable for indirect, incidental, or consequential damages. You agree to indemnify ChatSnag against claims arising from your content and from your use of the service in violation of law or of Meta's terms.

3. Your content

The DM text, links, and keywords you configure are your content. You are responsible for them. You warrant that you have the right to send what you send, and that it complies with applicable law, including spam, consumer-protection, and marketing rules in your jurisdiction, as well as Meta's Community Guidelines and platform policies.

4. Eligibility and Meta's terms

You must hold an Instagram professional account to use ChatSnag, and you must remain bound by the Instagram Terms of Use and the Meta Platform Terms. A breach of Meta's terms is also a breach of these Terms, which gives us the right to terminate your access.

5. Automation disclosure

Some jurisdictions require you to disclose that a message is automated. Meta's policy calls out California and Germany explicitly. As the business operator sending messages to your audience, you are responsible for making any legally required automation disclosure. ChatSnag helps where practical, including guidance in the product, but the compliance duty rests with you.

6. No delivery SLA and service changes

DMs can legitimately fail, for reasons including rate limits, the Instagram reply window, a commenter's closed DMs, or Meta outages and API changes. We provide no delivery service-level agreement. We may modify or discontinue features, including in response to changes Meta makes to the Instagram API.

7. Acceptable use

You may not use ChatSnag for harassment, spam, deceptive practices, or any prohibited or unlawful content. To protect the shared Instagram integration that all users depend on, we may suspend an account whose usage creates a risk of Meta enforcement against the platform.

8. Billing

Paddle is our merchant of record and handles billing, VAT, and sales tax. Your purchase is also subject to Paddle's buyer terms. We offer a refund on your first subscription purchase within seven days of that purchase. Renewals are non-refundable except where the law requires otherwise. Nothing in these Terms reduces any mandatory statutory right you have, including the European Union consumer right of withdrawal, which Paddle honors as merchant of record. Where the law grants you a stronger right, that right prevails.

During the beta period, access is comped or invitation-based. Features may change, the beta may end with notice, and we may use feedback you provide to improve the service.
